New Anesthesia Rule Revision Announced – Comments due to State Board by Sept. 30

In May, the Colorado State Board of Dental Examiners (SBDE) proposed a new rule on the administration of anesthesia in an attempt to better define and clarify the permit structure. Numerous dentists and patients expressed concerns about the original rule proposal at a public hearing on July 9.

In response to these concerns, the SBDE committees responsible for the draft made a number of revisions to the proposal. The most recent rule revision, issued this month, addresses many of the comments and concerns previously conveyed by CDA members.

COMOM Volunteers – Happy with a Handshake

The first Colorado Mission of Mercy (COMOM) patient arrived in line at 4:45 p.m., the night before the clinic opened. The second patient arrived shortly thereafter at 5:30 p.m. Despite a long night ahead of them, camping out in line, they were filled with good spirits and hope. Finally, after all these years, they’d be getting the dental care they desperately needed, and the pain would stop.

While COMOM was in Brighton, Colo. this year, the news of the annual charity clinic was known around the state. Thanks to well over 750 volunteers, hundreds of patients are resting easier and smiling with confidence – something that many of them hadn’t done in years and even decades before Sept. 11 and 12, 2009.

FTC Extends Red Flag Deadline Again

July 29,2009

The Federal Trade Commission (FTC) has issued another 90-day delay in the enforcement of its Red Flags Rule, which would have gone into effect this Saturday, Aug. 1. The FTC announced a delay until Nov. 1, 2009 on its Website today.

Thanks to many ADA and CDA members contacting lawmakers, the FTC has granted this extension to assist small businesses.

FDA Reaffirms Amalgam is Safe

Yesterday, July 28, after years of careful investigation and review of over 200 scientific studies, the U.S. Food and Drug Administration (FDA) reaffirmed its view that dental amalgam is a safe, effective material for use in dental restorations.

Call for Volunteers: Enteral Sedation Permit Holders

The CDA needs a few members who currently provide enteral sedation services and would be interested in providing their perspective in a focus group. The focus group would include both general dentists and specialists that represent a broad range of perspectives on the proposed anesthesia rule. The CDA plans to gather information and ideas from this group to take to the State Board.

State Board Returns Anesthesia Rule to Committee

On Thursday, July 9, the Colorado State Board of Dental Examiners (SBDE) held a public hearing on the proposed rule addressing anesthesia permits and administration.

Numerous dentists and patients attended the hearing and relayed their concerns about the rule proposal to the State Board.

Several testimonies were presented at the hearing. Some were supportive of the rule proposal and simply requested a few clarifications. Others vehemently opposed the rule, most frequently contesting the rule proposal's potential impact on oral sedation permits and expressing concern about patient access to oral sedation services should the new rule be implemented. Dr. David Lurye, president of the Colorado Dental Association, testified regarding the range of concerns conveyed to the CDA by its members.

HCPF Fluoride Claims Adjustment

July 10, 2009

Attention Medicaid Providers: The Department of Healthcare Policy and Financing contacted the CDA today wanting to inform members of a temporary system glitch in the Medicaid system. The computer error is denying dentist providers the fluoride varnish (D1206) reimbursement.

The Medicaid office is quickly rectifying this situation. Claims for these codes submitted under fee-for service that have been denied will be "mass adjusted" to pay in approximately 10 days.

State Board Revises Anesthesia Rule Proposal

The Colorado State Board of Dental Examiners (SBDE) has issued a new draft of the proposed rule on anesthesia permits and administration. The revised rule proposal includes new sections that outline how the Board intends to transition current licenses and further detail the requirements for nitrous oxide administration. It also makes some editorial changes for clarification.

State Board Revises Anesthesia Rule and Permit Structure

June 1, 2009

The Colorado State Board of Dental Examiners (SBDE) recently revised its rule on the administration of anesthesia in an attempt to better define and clarify the permit structure. The proposed rule would reduce the four current anesthesia permits to two proposed permits. The new rule is based on an "anesthesia continuum" that ranges from local to general anesthesia, and focuses on the sedation level of the patient rather than on specific drugs or routes of administration. Requirements become more stringent as one progresses to deeper levels of sedation on the continuum.

Under the new rule, licensed dentists could provide local anesthesia, analgesia and anxiolysis without a permit. In most cases a permit would not be required for nitrous oxide applications performed by a dentist.
